He said to the man: \u201cWhich happens more, your turtle-dove\u2019s cooing or its silence?\u201d The said: \u201cIts cooing\u201d. Al-Sh\u0101fi\u2019\u012b said: \u201cYour marriage is valid and there is no penalty for you [due to your oath].\u201d Whereupon M\u0101lik frowned at him saying: \u201cBoy, how do you know this?\u201d <!--more-->Al-Sh\u0101fi\u2019\u012b replied: \u201cBecause you narrated to me from al-Zuhr\u012b, from Abu Salama ibn \u2018Abdur-Rahm\u0101n from Umm Salama that F\u0101tima bint Qays said: \u2018Ras\u016blullah! Abu Jahm and Mu\u2019\u0101wiya have both proposed to me.\u2019 The Prophet (sa) replied: \u2018Mu\u2019awiya is penniless and as for Ab\u016b Jahm he does not put down his staff from his shoulder.\u2019<sup><a id=\"identifier_10_579\" title=\"possibly two meanings: he is a wife-beater, or he travels a lot for further clarification see footnote 449 of The Four Imams by G.f. Haddad \" href=\"http:\/\/www.shafiifiqh.com\/the-biography-of-imam-ash-shafii\/#footnote_10_579\">11<\/a><\/sup> That is, most of the time \u2018Arabs assert the more frequent of two actions [exclusively of the other] because of its constancy. Since this man\u2019s turtledove coos more than it is silent, I can declare it constant in its cooing.
